The objective of this chapter is to expose the ‘umbilical cord’ that linked the notion of ‘constitutional’ rights and the will theory, on one side, and the internal incompatibility of notion of ‘inalienable rights’ with the will theory – reflecting an unabated conflict of the doctrines of parliamentary supremacy and constitutional rights, on another side. These doctrines are part of both ‘continental’ and ‘common law’ traditions. Our intent is also to reflect on the shared groundwork of the doctrine of sovereignty of Hobbes, Aus…

During this period on the wave of the democratization process of public institutions in the US, popular elections were introduced to select judges at the state level. The result of popular electi…
Il diritto europeo e la «giustizia contrattuale»
2015
The essay deals with the issue of « contractual justice » in light of European private law. The author reports the extreme variety of problems brought under the formula « contractual justice » and tries to propose a definition of the notion, restricting it to the legal institutions that allow for judicial review of the contractual relationship, in view of its rebalancing. The most intricate issue concerns the conditions under which these forms of intervention, moreover very heterogeneous, can be accomplished. The paper analyzes the main opinions that range from the concepts of procedural justice to that of substantive justice, proposing a reading that goes beyond the procedural conceptions.

Aiuti di Stato all’interno di uno stesso gruppo societario: profili sostanziali e processuali
2022
The essay deals with a State aid case between companies belonging to the same corporate group. To clarify the concepts of ‘State resources’ and the misure imputable to the State, the essay suggests framing the concrete case within the framework of the so-called “in-house” company. This does not rule out the application of the private investor test in normal market conditions, which – if disregarded – can overcome the indistinction typical of “in-house” companies.
